Terms of Use

The University of King’s College (“King’s”) provides you with access to our website at www.ukings.ca and any other domains, sub-domains or web pages maintained by or on behalf of us (collectively, the “Site”) subject to the following terms and conditions (“Terms of Use”).

Agreement to these Terms of Use

By using the Site, you indicate your agreement to be legally bound by these terms of use, by our Privacy Statement [PDF], the Dalhousie Acceptable Use Policy [PDF], and by all applicable laws and regulations governing the Site. You further agree to the use of any information that we may gather relating to you as a result of your use of the Site, as further described in our Privacy Statement [PDF].

Updates to these Terms of Use

King’s reserves the right to update these Terms of Use at any time without notice. If we do so, we will post the changes on this page and indicate at the top of the page when the Terms of Use were last updated. Please review these Terms of Use regularly to ensure that you are aware of such changes. Your continued use of the Site after such changes are posted indicates your agreement to be legally bound by the updated Terms of Use.

Acceptable Use Policy

You agree that you have read, understood and accepted, and that your use of the Site shall comply with the terms of Dalhousie’s Acceptable Use Policy [PDF].

You agree to use the Site for lawful purposes and only as expressly permitted in this Terms of Use and for no other purpose. You agree that you will not post or transmit through the Site any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law, or which, without King’s express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by you that in our discretion restricts or inhibits any other user from using or enjoying the Site will not be permitted.

Sub-Sites

The Site may include unmoderated forums containing the personal opinions and other expressions of the persons who post entries on a wide range of topics. Neither the content of such Sites, nor the links to other web sites, are screened, approved, reviewed or endorsed by King’s. The Site may also include material and webpages that are created and/or maintained by third parties, such as students, student associations and other such organizations. King’s is not a publisher of any of the content of such Sites, or of any content that may be available through links to and from them, and is acting solely as an Internet service provider.

The text and other material on these Sites are the opinion of the specific author and are not statements of advice, opinion, or information of King’s. If you feel you might be offended by the content of the Sites, you should not continue.

Copyright / Permission to Reproduce

Materials accessible on the Site were produced and/or compiled by King’s or King’s has acquired the necessary licenses to display the material on the Site. These materials are protected by the Copyright Act and by Canadian laws, policies, regulations and international treaties and agreements.

Unless otherwise indicated on any particular web page or document, your use of any content from the Site is subject to the following license: As a user of this Site, you are granted a limited license to use (display or print) short extracts of text for your own personal, educational or non-commercial use only, provided the information is not modified. Any other use of the information is prohibited. None of the information may be otherwise reproduced, republished or re-disseminated in any manner or form without the prior written consent of the University of King’s College. Except for search engines that make their results generally available to the public at no charge and that follow the Robots Exclusion Standard/Protocol, systematic retrieval of data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database or directory in any form whatsoever without our written permission is strictly prohibited.

This permission excludes any material for which King’s states that it does not hold copyright.

Permission is not given for the use of any images, trademarks or logos, unless specific arrangements are made with King’s.

Contact Information

Contact information for faculty, staff and students may be found on the Site. The exclusion of such information does not imply consent on the part of those individuals to be contacted for any purpose other than directly in connection with (i) the purpose for which such contact information was provided and/or (ii) the job functions of the individual.

Disclaimer

Although reasonable efforts are taken to maintain and update the information contained in the Site, King’s does not and cannot guarantee its accuracy. Many pages will indicate when they were last updated and out of date content may persist on the Site.

Your use of the Site is at your own risk; any loss arising from the use of information on the Site is your sole responsibility.

You expressly accept that King’s is not responsible for and expressly disclaims any responsibility, whether express or implied, for the accuracy, adequacy, or completeness of the Site or for the consequences, whether direct or indirect and whether known or unknown, of using the Site. Certain words, phrases, names, designs or logos used on the Site may constitute trade-marks, prohibited marks, service marks or trade names of King’s or other entities. The display of any such marks or names on the Site does not imply that the University of King’s College or other entities have granted a license or authorization of any kind to use such marks or names.

Please note that certain links on the Site may take you to other websites. King’s provides these links only as a convenience and not as an endorsement by King’s. These linked sites are not necessarily under the control of King’s and King’s is not responsible or liable for the privacy practices, content, opinions, accuracy, or administration of any such linked sites or any other web page which is not under King’s control.

Governing Law & Jurisdiction

You expressly agree that any complaints, disputes, claims or actions you choose to advance arising from your use of the Site will be decided by the courts established under and applying the laws of Nova Scotia, excluding the law relating to choice of law and inconvenient forum. You further expressly agree that you submit to the jurisdiction of the Courts of Nova Scotia for the purpose of resolving any such dispute, claim, complaint, or action.
